AI and Copyright: What Content Creators Need to Know

By AI Free Skills·7 min read·Updated Jun 21, 2026

AI and copyright law are on a collision course. Can you copyright AI-generated content? Can AI companies use your work to train models? The answers are still evolving, but here's what we know — and what creators should do.

Can You Copyright AI-Generated Content?

The short answer: it depends on how much human involvement there was.

  • Pure AI output — The US Copyright Office has ruled that purely AI-generated content cannot be copyrighted. No human authorship = no copyright.
  • Human + AI collaboration — Content where a human selects, arranges, and curates AI output may qualify for copyright. The human creative choices are what's protected.
  • AI as a tool — Using AI like any other tool (grammar checker, spell checker, Photoshop) doesn't affect copyright. The human is still the author.

Can AI Use Your Work for Training?

This is the subject of multiple ongoing lawsuits from artists, writers, and publishers against AI companies. Key questions:

  • Fair use? — AI companies argue that training is "transformative use" (fair use). Creators argue it's mass copyright infringement.
  • Opt-out — Some AI companies now offer opt-out mechanisms (robots.txt, AI.txt, direct requests)
  • Compensation — Some publishers have licensing deals with AI companies; most don't

Protecting Your Creative Work

  1. Register copyrights for your most valuable work (provides legal protection regardless of AI)
  2. Use robots.txt and AI.txt to signal your preferences on training data use
  3. Watermark visual content
  4. Monitor for unauthorized use of your style or content
  5. Stay informed — this area of law is changing rapidly

Using AI Content Safely

  • Add significant human creativity to AI output before publishing
  • Don't represent AI-generated content as entirely human-created (ethical and increasingly legal concern)
  • Keep records of your creative process showing human involvement
  • Check AI-generated images for copyrighted elements (logos, characters, trademarked designs)
